It is uncertain if States are willing to use their military or economic force to extricate an oppressive leader from their country. The ICC itself <\/span><\/span><a href=\"https:\/\/papers.ssrn.com\/sol3\/Delivery.cfm\/SSRN_ID2752682_code109222.pdf?abstractid=275%202682&amp;mirid=1\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">lacks the institutional resources<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> to ensure that the defendants actually show up in <\/span><\/span><span face=\"Times New Roman, serif\">C<\/span><span face=\"Times New Roman, serif\"><span size=\"3\">ourt as it has no police force of its own and<\/span><\/span><span face=\"Times New Roman, serif\"> has<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> no reliably effective means to oblige States to cooperate. An illuminating <\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">example<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> of this is the ICC&#x2019;s request to arrest and surrender Sudan&#x2019;s President <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/darfur\/albashir\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">Omar Al-Bashir<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> for the commitment of the crimes under Article 5. The arrest warrant, first issued in 2009, was ignored by 19 different countries, <\/span><\/span><a href=\"https:\/\/asp.icc-cpi.int\/EN_Menus\/asp\/non-cooperation\/pages\/default.aspx\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">9<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> of with are signatories of the Rome Statute. <\/span><\/span><\/p>\n<p><span face=\"Times New Roman, serif\">Due to weak enforcement power, <\/span><span face=\"Times New Roman, serif\"><span size=\"3\">the Prosecutor&#x2019;s <\/span><\/span><span face=\"Times New Roman, serif\">performance<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> of gathering information would also be hindered. As noted by one <\/span><\/span><a href=\"https:\/\/books.google.co.kr\/books\/about\/Rough_Justice.html?id=9knAoQEACAAJ&amp;redir_esc=y\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">commentator<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\">, &#x201C;pursuing an ideal apolitical form of justice by ignoring the need for State support would only sap the [ICC&#x2019;s] credibility&#x201D;. This thus forces the Prosecutor to <\/span><\/span><span face=\"Times New Roman, serif\">assess<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> the likely State support before launching an investigation. It is precisely upon this consideration that the Pre-Trial Chamber <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/CourtRecords\/CR2019_02068.PDF\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">ruled<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> the investigation into Afghanistan would not be in the &#x201C;interests of justice&#x201D; by reason of the scarce cooperation obtained by the Prosecution. <\/span><\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#x201D;1&#x2033; _builder_version=&#x201D;3.19.18&#x2033; custom_padding=&#x201D;30px|0px|0|0px|false|false&#x201D;][et_pb_row _builder_version=&#x201D;3.19.18&#x2033; custom_padding=&#x201D;0|0px|0|0px|false|false&#x201D;][et_pb_column type=&#x201D;4_4&#x2033; _builder_version=&#x201D;3.19.18&#x2033;][et_pb_text _builder_version=&#x201D;3.19.18&#x2033;]<\/p>\n<h4><span face=\"Times New Roman, serif\"><span size=\"3\">Low Conviction Rates<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">: <\/span><\/span><\/h4>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">Connected with the above criticism is the questioning that it took the ICC 16 years to convict <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/Pages\/defendants-wip.aspx#Default=%7B\" target=\"_blank\" rel=\"noopener noreferrer\">less than ten suspects<\/a><span face=\"Times New Roman, serif\"><span size=\"3\">. However, <\/span><\/span><a href=\"https:\/\/link.springer.com\/book\/10.1007\/978-3-319-78015-3\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">academics<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> have analysed that <\/span><\/span><span face=\"Times New Roman, serif\">because<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> of the complexity of the crimes, &#x201C;the sheer size of international trials with multiple crime sites, a high number of distinct charges&#x201D;, the sheer amount of witnesses and volume of documentation per case all lead to a high degree of legal and factual compliance. Moreover, the ICC is <\/span><\/span><span face=\"Times New Roman, serif\">not entirely<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> to blame. Effective administration of justice in the context of the ICC requires the cooperation of the States concerned, which, as demonstrated above, is often lacking. <\/span><\/span><\/p>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">Some measures have been introduced to <\/span><\/span><span face=\"Times New Roman, serif\">improve<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> the situation. Under <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/Publications\/Rules-of-Procedure-and-Evidence.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">Rule 100<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\">, the ICC is now able to decide on the place of proceedings. Under <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/Publications\/Rules-of-Procedure-and-Evidence.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">Rule 68<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\">, previously recorded audio or video testimony of a witness is allowed to accelerate the trial. <\/span><\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#x201D;1&#x2033; _builder_version=&#x201D;3.19.18&#x2033; custom_padding=&#x201D;30px|0px|0|0px|false|false&#x201D;][et_pb_row _builder_version=&#x201D;3.19.18&#x2033; custom_padding=&#x201D;0|0px|0|0px|false|false&#x201D;][et_pb_column type=&#x201D;4_4&#x2033; _builder_version=&#x201D;3.19.18&#x2033;][et_pb_text _builder_version=&#x201D;3.19.18&#x2033;]<\/p>\n<h4><span face=\"Times New Roman, serif\"><span size=\"3\">Exclusive Focus on African Countries<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">: <\/span><\/span><\/h4>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">Many African countries have repeatedly <\/span><\/span><a href=\"https:\/\/repository.law.umich.edu\/cgi\/viewcontent.cgi?article=1030&amp;context=mjil\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">criticised<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> the ICC as being inappropriately political by only focusing on situations in Africa. At one extreme, some <\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">consider<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> this seemingly unjustified practice <\/span><\/span><span face=\"Times New Roman, serif\">as an attempt<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> by the Western States &#x201C;<\/span><\/span><a href=\"https:\/\/www.herald.co.zw\/icc-agent-of-neo-colonialism\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">to keep African countries counties compliant to the dictates of the West and its allies<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\">&#x201D; or &#x201C;<\/span><\/span><a href=\"https:\/\/ecollections.law.fiu.edu\/cgi\/viewcontent.cgi?referer=&amp;httpsredir=1&amp;article=1249&amp;context=faculty_publications\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">the sacrificial lambs in the ICC&#x2019;s struggle for global legitimation<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\">&#x201D;. So far, <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/Pages\/defendants-wip.aspx#Default=%7B\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">every <\/span><\/span><\/span><\/a><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">convicted person<\/span><\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> <\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">has been African.<\/span><\/span><\/p>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">Despite the assertion, most of the African situations were <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/pages\/situations.aspx\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">referred to<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> the ICC by African governments themselves. Secondly, it is the individuals but not the States that <\/span><\/span><span color=\"#000000\"><span face=\"Times New Roman, serif\">were<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> suspected of exceptionally grave crimes and consequently subject to ICC criminal <a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;jurisdiction&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;an area within which a particular system of laws is used&amp;lt;br \/&amp;gt;Source:&nbsp;&amp;lt;span style=&amp;quot;color: #000000;&amp;quot;&amp;gt;&amp;lt;span style=&amp;quot;font-family: Cambria, serif;&amp;quot;&amp;gt;&amp;lt;span style=&amp;quot;font-size: medium;&amp;quot;&amp;gt;Merriam-Webster Learner&rsquo;s Dictionary&amp;lt;\/span&amp;gt;&amp;lt;\/span&amp;gt;&amp;lt;\/span&amp;gt;&lt;\/div&gt;\"  href=\"https:\/\/accessaccountability.org\/index.php\/glossary\/jurisdiction\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>jurisdiction<\/a>. <\/span><\/span><span color=\"#000000\"><span face=\"Times New Roman, serif\"><span size=\"3\">Perhaps a better <\/span><\/span><\/span><a href=\"https:\/\/heinonline.org\/HOL\/LandingPage?handle=hein.journals\/ncjint43&amp;div=21&amp;id=&amp;page=\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">question to ask<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\">, is why the ICC is doing so little elsewhere. <\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">Thirdly<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">, there is <\/span><\/span><a href=\"https:\/\/heinonline.org\/HOL\/LandingPage?handle=hein.journals\/ncjint43&amp;div=21&amp;id=&amp;page=\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">no evidence<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> showing any of the ICC prosecutions in Africa were unjustified.<\/span><\/span><\/p>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">In January 2016, the Prosecutor of the ICC was <\/span><\/span><a href=\"https:\/\/www.legal-tools.org\/doc\/a3d07e\/pdf\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">authorised<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> by the ICC Pre-Trial Chamber to start an investigation into the situation of Georgia, which is the first non-African situation under the Court&rsquo;s <a class=\"glossaryLink\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;jurisdiction&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;an area within which a particular system of laws is used&amp;lt;br \/&amp;gt;Source:&nbsp;&amp;lt;span style=&amp;quot;color: #000000;&amp;quot;&amp;gt;&amp;lt;span style=&amp;quot;font-family: Cambria, serif;&amp;quot;&amp;gt;&amp;lt;span style=&amp;quot;font-size: medium;&amp;quot;&amp;gt;Merriam-Webster Learner&rsquo;s Dictionary&amp;lt;\/span&amp;gt;&amp;lt;\/span&amp;gt;&amp;lt;\/span&amp;gt;&lt;\/div&gt;\"  href=\"https:\/\/accessaccountability.org\/index.php\/glossary\/jurisdiction\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>jurisdiction<\/a>. There is also an <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/CourtRecords\/CR2019_03060.PDF\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">appeal<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> against the Pre-Trial Chamber&#x2019;s decision not to authorise an investigation into alleged war crimes <\/span><\/span><a href=\"https:\/\/www.icc-cpi.int\/CourtRecords\/CR2019_02068.PDF\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">committed by<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\">, <\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">inter alia<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">, US Forces, CIA and members of international armed forces. <\/span><\/span><\/p>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">The above analysis <\/span><\/span><span face=\"Times New Roman, serif\">has<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> led <\/span><\/span><a href=\"https:\/\/heinonline.org\/HOL\/LandingPage?handle=hein.journals\/ncjint43&amp;div=21&amp;id=&amp;page=\" target=\"_blank\" rel=\"noopener noreferrer\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">some authors<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> to conclude that the opposition to the ICC reflects the interest of some leaders to protect themselves from the Court&#x2019;s scrutiny. <\/span><\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=&#x201D;1&#x2033; _builder_version=&#x201D;3.19.18&#x2033; custom_padding=&#x201D;30px|0px|0|0px|false|false&#x201D;][et_pb_row _builder_version=&#x201D;3.19.18&#x2033; custom_padding=&#x201D;0|0px|0|0px|false|false&#x201D;][et_pb_column type=&#x201D;4_4&#x2033; _builder_version=&#x201D;3.19.18&#x2033;][et_pb_text _builder_version=&#x201D;3.19.18&#x2033;]<\/p>\n<h4><span face=\"Times New Roman, serif\"><span size=\"3\">Lack of Resources<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">: <\/span><\/span><\/h4>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">While the ICC is <\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\">directed<\/span><\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> to try the most serious crimes, it is given &#x201C;a <\/span><\/span><a href=\"https:\/\/repository.law.umich.edu\/cgi\/viewcontent.cgi?article=1030&amp;context=mjil\"><span color=\"#1155cc\"><span face=\"Times New Roman, serif\"><span size=\"3\">budget<\/span><\/span><\/span><\/a><span face=\"Times New Roman, serif\"><span size=\"3\"> that enables only a handful of prosecutions per year&rdquo;. Because of the small number of sitting judges, the ICC can hear only a limited number of cases at any given time. It should be recognised that the global legitimacy and the normative effect of the Rome Statute <\/span><\/span><span face=\"Times New Roman, serif\">correlate<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> positively with the number of ICC member States. The more States willing to <\/span><\/span><span face=\"Times New Roman, serif\">assist<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> the Court, the more effective it could become, for example, in the process of obtaining evidence or arresting suspects. <\/span><\/span><\/p>\n<p><span face=\"Times New Roman, serif\"><span size=\"3\">The <\/span><\/span><span face=\"Times New Roman, serif\">example<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> of Omar Al-Bashir above demonstrates cooperation even from signatory States <\/span><\/span><span face=\"Times New Roman, serif\">remains<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> lacking. The very design of the ICC entrenches a two-pillar system where the Court <\/span><\/span><span face=\"Times New Roman, serif\">serves<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> as the judicial pillar while States act as the enforcement pillar. Without State cooperation, the Court is rendered unworkable as it has no enforcement mechanism of its own. Furthermore, lack of cooperation could increase the <\/span><\/span><span face=\"Times New Roman, serif\">operating<\/span><span face=\"Times New Roman, serif\"><span size=\"3\"> costs and diminish the Court&#x2019;s ability to deliver justice in the eyes of the victims.
